These Terms of Use ("Terms") govern your access to and use of the @DearestWatson platform ("the Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. About the Platform
@DearestWatson provides a leadership development platform offering assessments, insights, AI-powered coaching, and team analytics designed to support individual and organizational growth.
2. Eligibility & Accounts
- You must be at least 18 years old to use the Platform.
- Access is typically granted through your organization or via direct invitation.
- You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
- You agree to provide accurate, current, and complete information when registering or completing assessments.
3. Acceptable Use
When using the Platform, you agree not to:
- Use the Platform for any unlawful, harmful, or fraudulent purpose
- Attempt to access accounts, data, or systems that do not belong to you
- Reverse engineer, decompile, or attempt to extract the source code of the Platform
- Interfere with, disrupt, or place undue load on the Platform's infrastructure
- Upload malicious code, scrape content, or use automated tools to access the Platform without permission
- Use Watson output to harm, harass, or discriminate against others
4. Watson & Generated Content
The Platform uses AI to generate insights, recommendations, and coaching responses. You acknowledge and agree that:
- AI-generated content is provided for reflection, development, and—where a governed company pilot is enabled—manager and staffing decision support
- It is not a substitute for professional advice (legal, medical, financial, psychological, or HR)
- AI output may contain inaccuracies or limitations and should be evaluated with your own judgment
- You should not rely solely on Watson output to make significant personal, professional, or organizational decisions
- Staffing, succession, team-composition, promotion, performance, compensation, and work-allocation decisions remain the responsibility of an authorized human. Watson cannot make or execute those decisions.
- Leaders must use only legitimate, agreed requirements; verify self-declared and assessment-derived evidence; consider missing or contradictory information; provide a correction or contestability path; and comply with applicable employment, data-protection, consultation, and AI-governance duties.
5. Your Content & Data
You retain ownership of the information you provide (e.g. assessment responses, chat inputs). By using the Platform, you grant @DearestWatson a limited license to process this content solely to operate, personalize, and improve the service in accordance with our Privacy Policy.
You are responsible for ensuring that any content you submit does not violate the rights of others or applicable laws.
6. Intellectual Property
The Platform, including its design, frameworks, assessments, models, and underlying software, is the intellectual property of @DearestWatson and is protected by applicable copyright and trademark laws. You may not copy, distribute, or create derivative works based on the Platform without prior written consent.
7. Confidentiality
When using the Platform within a team or organizational context, you agree to treat insights, results, and feedback about other participants as confidential and to use them only for legitimate development purposes.
8. Service Availability
- We strive to keep the Platform available and reliable but do not guarantee uninterrupted access.
- We may update, modify, or discontinue features at any time to improve the service.
- Scheduled maintenance and unforeseen outages may occasionally affect availability.
9. Suspension & Termination
We may suspend or terminate your access to the Platform if you violate these Terms, misuse the service, or engage in conduct that could harm other users, our partners, or the Platform itself.
You may stop using the Platform and submit an account-erasure request directly within the product. Shared records and lawful retention requirements are reviewed before completion.
10. Disclaimers
The Platform is provided "as is" and "as available." To the maximum extent permitted by law, @DearestWatson disclaims all warranties, express or implied, including fitness for a particular purpose, accuracy of AI-generated output, and uninterrupted availability.
Insights and assessments are developmental tools — not diagnostic, clinical, or evaluative instruments.
11. Limitation of Liability
To the maximum extent permitted by law, @DearestWatson shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform, including loss of data, business interruption, or decisions made based on AI-generated content.
12. Changes to These Terms
We may update these Terms from time to time. If changes are significant, you will be asked to review and re-accept the updated Terms before continuing to use the Platform.
13. Governing Law
These Terms are governed by the laws of Denmark. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the Danish courts.
